FCC Reaches Settlement Over Illegal Pirate Radio Operation

The Federal Communications Commission (FCC) has reached a settlement with Wilfrid Salomon of Lauderdale Lakes, Florida, over the unauthorized operation of a pirate radio station on 87.9 MHz. The Enforcement Bureau entered into a Consent Decree with Salomon to resolve its investigation into illegal broadcasts that took place on February 5, February 25, and March 5, 2023.

According to the FCC, Salomon operated a station known as “Radio Ideal” without a license, transmitting at power levels that exceeded limits for unlicensed use under federal rules. The unauthorized broadcasts took place from a location in Lauderdale Lakes and violated Section 511 of the Communications Act, which imposes penalties for pirate radio broadcasting.

The Commission had initially proposed a forfeiture of $358,665, but Salomon submitted financial documentation indicating he was unable to pay that amount. As part of the settlement, he agreed to pay a reduced civil penalty of $11,000 in 22 monthly installments of $500. However, should Salomon default on this agreement or resume illegal broadcasting, an additional penalty of $347,665 will become immediately due.

In the decree, Salomon acknowledged the FCC’s findings and committed to permanently ceasing all unauthorized broadcasting. The FCC also confirmed that the station is no longer operating.

“Operating an unauthorized, or pirate, radio station is illegal under the Communications Act and undermines the FCC’s mission to manage radio spectrum,” the Bureau stated. “Such operations can interfere with licensed communications, including public safety transmissions.”

The Consent Decree also binds Salomon to report any future noncompliance and bars him from aiding other pirate operations for a period of 20 years. If he fails to comply, interest and collection costs will accrue on any outstanding balance.
